Evangeline is the managing partner of Stephenson Harwood's Greater China offices. She specialises in commercial dispute resolution, with particular focus on complex marine and international trade matters. Her practice covers all stages of dispute resolution from obtaining security to running court or arbitration proceedings and enforcement.

Evangeline has significant and deep cross-border experience having practiced in three key commercial hubs in Asia over the past fifteen years – Singapore, Hong Kong and Shanghai. She is now based in Hong Kong and spends part of her time in Shanghai. She has appeared on behalf of clients in the Singapore and Hong Kong Courts and managed disputes for her clients in Singapore, Mainland China, Taiwan, India, Bangladesh, Holland, England and the United States. She advise and represents clients in international arbitrations applying institutional rules of the SIAC, HKIAC, CIETAC and ICC and ad hoc arbitrations applying the LMAA Rules and the UNCITRAL Model Law.

For contentious shipping matters, her expertise extends to all types of charterparty, cargo defence, shipbuilding, bunkering and ship financing disputes. She is instructed on a regular basis by international group P&I Clubs, shipowners, charterers, operators, banks and finance leasing institutions in Hong Kong, Taiwan and the PRC.

She has also acted for debtors and creditors in shipping and non-shipping restructuring and insolvency matters arising from and relating to Hong Kong insolvency proceedings, Japanese rehabilitation proceedings, Korean rehabilitation proceedings and the Indian Insolvency and Bankruptcy Code that came into force in 2016.  

In the past four years, Evangeline has developed a transactional practice where she has acted for financial leasing institutions and owners in negotiating and drafting suites of bespoke operational leasing documents for her clients.

Evangeline is qualified in Singapore (non-practicing), England and Wales and Hong Kong. In addition to English, she speaks fluent Chinese and conversational Cantonese.

Charterers

Advising and representing various charterers in relation to disputes arising under time and voyage charters, including speed and performance, dangerous cargo, incidents of fire and unseaworthiness issues.

Representing liner operator in relation to various container stack collapse claims.

Bills of lading

Advising and representing various shipowners and charterers in relation to claims brought under bills of lading for damage and/or loss of cargo.

Advising shipowners in relation to issues arising from delivery without production of original bill of lading.

Advising a liner operator on electronic bills of lading.

Shipbuilding

Successfully represented shipowners in arbitration with a Chinese shipyard that failed to construct vessels, successfully claiming on Chinese refund guarantees.

Finance leasing companies

Advising and representing finance leasing companies in the repossession of vessels where the borrower is unable to perform its obligations under the financing documents. We usually have overall conduct of such matters and have to advise on the finance leasing companies’ rights and remedies under the loan documentation. After which, if the bareboat charterers are not cooperative, we are required to coordinate and work with foreign lawyers in various jurisdictions to re-possess the Vessel and recover the outstanding amounts.

International trade

Advised a power company in various issues arising under sale and purchase of coal and actin company in significant dispute arising from sale and purchase of coal.

Advising a major trading house on the Chinese and Hong Kong law aspects of their successful defence of a headline-making US$270 million claim, relating to “repo” deals affected by a major metals warehousing fraud in Qingdao. Particular advices on transfer of title in sale of goods contracts.

Representing sellers in relation to LC disputes arising out of the sale of goods in to Vietnam, VIAC arbitrations and injunctions from the Vietnam courts.

Acted for a major finance leasing company in respect of a difficult situation where the borrower had defaulted on their obligations under the finance documentation and refused to cooperate with the company in the repossession. We had overall conduct of the matter, advising on the English law issues arising out of the financing documentation and working with lawyers in other jurisdictions such as Thailand, England and the BVI to successfully repossess the vessel.

Acting for and representing a major Chinese owner in respect of all the disputes arising out of the collapse of OW Bunker in November 2014. We successfully settled the claims with OWB’s Receivers, ING, and are presently working with lawyers in Rotterdam, New York and Singapore to assist the owner in defending claims in court proceedings or arbitration from physical suppliers.

Acting in various matters with instructions coming from the Shanghai office of a P & I Club in the International Group.

Acting for a Hong Kong shipowner in various claims for demurrage against a significant Hong Kong charterer that has now gone insolvent.
