Adam has acted on a wide range of complex commercial disputes, often in the Commercial Court, with a particular focus on cross-border disputes, director and shareholder disputes and international arbitration.

Confident assisting clients through all stages of litigation, Adam also has in depth experience of interlocutory hearings, representing his clients in relation to interim injunctions, freezing orders, third party debt orders, disclosure orders and applications for security for costs.

Shareholder disputes

Acted for a prominent Ukrainian oligarch in complex multi-party proceedings in the Commercial Court in relation to a number of very substantial claims and counterclaims following the termination of business dealings between three former business partners.

Successfully settled a long-running dispute between deadlocked shareholders in a telecoms business.

Unfair prejudice

Acting for the petitioner in a s994 petition (unfair prejudice) against a director and shareholder in a major global luxury and fashion company. The claim involves breaches of contract and fiduciary duty.

Freezing relief

Acted for a foreign investment bank in proceedings in the High Court challenging the registration of a worldwide freezing order made in the Cypriot Court.

Various Claimants v Visa Europe Ltd and others; Various Claimants v MasterCard Inc and others

Acting for over 1,000 claimants in 14 separate claims against Visa and MasterCard for the recovery of interchange fees that were imposed on the claimants by the card schemes in contravention of European and UK competition law. The claims are valued at over £500 million.

International arbitration

Acted for a Dutch provider of management services in high value LCIA proceedings against a Central European State (and state-owned company) arising out of the privatisation of a steel manufacturing plant.

Professional negligence and breach of fiduciary duty

Acted for the joint liquidators of a development company against its former joint administrators for breach of duty in relation to the conduct of the administration.

Injunctive relief

Successfully applied for injunctive relief on behalf of the leading provider of official controls to the FSA in a dispute with its former managing director.

Investor disputes

Acted successfully for a European commodities trader in a dispute with a trading platform regarding the early closing of its hedging positions.
