Lucy is an associate in our commercial litigation department, who advises on disputes encompassing a number of sectors. Lucy has particular experience in aviation litigation and regulation.

Lucy has advised on a wide range of disputes in the aviation sector, ranging from breach of contract claims through to enforcement action brought by a national regulator, and involving both High Court litigation and international arbitration.

She has advised on aviation regulatory matters and assisted airlines in respect of investigations by regulators such as the Civil Aviation Authority and the Competition and Markets Authority.

During the COVID-19 pandemic, Lucy has advised clients on the introduction of new legislation by national governments and has helped clients to navigate the constantly evolving regulatory landscape.

Middle Eastern airline

Represented a Middle Eastern Airline in ICC arbitration proceedings in relation to alleged breach of a joint venture agreement and unjust enrichment.

Judicial Review

Represented Ryanair DAC in judicial review proceedings brought against the UK Civil Aviation Authority relating to Alternative Dispute Resolution scheme administered by the CAA for passenger claims.

Regulatory and commercial advice 

Advising on a variety of commercial and regulatory aspects, including enforcement proceedings, advertising queries, changes to regulations and legislation and reviewing airlines' booking process and General Terms and Conditions of Carriage to ensure compliance.

Covid-19

Defending a European airline in an investigation by the Competition and Markets Authority into the airline's refund practices and procedures for cancelled flights.

Advising an airline on Covid-19 travel regulations including reviewing the airline's booking and check-in process to ensure compliance, updating the airline on changes to the regulations, fixed penalty notices and advising on the Civil Aviation Authority's enforcement powers.

Advising on potential advertising claims prior to broadcasting to ensure compliance with the Advertising Standards Agency's codes.

Covid-19

Advising an airline on Covid-19 travel regulations including reviewing the airline's booking and check-in process to ensure compliance, updating the airline on changes to the regulations, fixed penalty notices and advising on the Civil Aviation Authority's enforcement powers.

UK Border Force

Advising an airline on liability in relation to failure to comply with UK Border Force's data requirements for submitting crew and passenger information. 

Middle Eastern airline

Represented a Middle Eastern Airline in ICC arbitration proceedings in relation to alleged breach of a joint venture agreement and unjust enrichment.

European airline

Defending a European Airline against a claim brought by an online travel agent for breach of competition, consumer and contract law and alternatively for causing loss by unlawful means.

Disputes with airports

Acted for a major European airline in relation to a dispute with a European airport regarding the classification of routes and the levels of airport charges under an airport services agreement. 

Cartels

Acting for an international bank in a European Commission cartel investigation, including submitting confidentiality claims, applying for leniency and appealing against the Commission decision.

Abuse of market power

Defending a European Airline against a claim brought by an online travel agent for breach of competition, consumer and contract law and alternatively for causing loss by unlawful means.

Commercial agreements

Advising clients on compliance with competition law in vertical agreements including price parity clauses, online restrictions and exclusivity arrangements.
