Emily is a partner in our Hong Kong office with extensive experience in commercial litigation and dispute resolutions, with a focus in contentious liquidation and insolvency matters, as well as international trade finance disputes.

Emily was admitted as a solicitor in Hong Kong in 2012.

Prior to joining Stephenson Harwood, Emily worked in the litigation department of a major international firm, and has experience in advising liquidators and provisional liquidators in contentious and non-contentious liquidation matters, as well as shareholders disputes.

Emily is also experienced in regulatory matters having assisted in various investigations conducted by the Stock Exchange of Hong Kong, Securities and Futures Commission and Hong Kong Monetary Authority.

Another focus of Emily’s practice is international trade finance disputes.  She has acted for various major Chinese banks on their disputes relating to letters of credit.

Emily also has experience in advising clients in arbitration proceedings with the HKIAC.

Emily speaks fluent English, Cantonese and Mandarin.

Acting for the Liquidator to seek directions from the Court on distribution of the company’s assets, which involve novel issues of ad-valorem fees and set-off.

Acting for the liquidator on matters relating to the general winding up of a large group of companies involving 60 subsidiaries holding assets of over HK$200 million, including various investigations on pre-winding up transactions of the company.

Acting for the provisional liquidators of a major company on various matters including obtaining an urgent injunction against certain companies restraining them from selling shares held by a subsidiary of the company, commencing action against certain companies for a declaration that a share pledge is invalid, and applying to the court under s.221 of the Companies (Winding Up and Miscellaneous Provisions) Ordinance for examination of certain officers of the company.

Acting for over 2,000 employees from a PRC company on various high profile and complex litigations in Hong Kong involving shares in a listed company in Hong Kong of over HK$5,000 million worth.

Advising a major Australian book sellers in relation to its disputes with another shareholder, leading to an application for statutory intervention.

Advising a major Dutch bank in its various actions against the borrower and guarantors for recovery of debt in the sum of over USD60 million.

Advising a high net worth PRC individual in a dispute with the minority shareholder, including working together with BVI lawyers in respect of a statutory buy out process pursuant to s. 176 of the BVI Business Companies Act 2004.

Advising certain high net worth PRC individuals (as minority shareholders) in their dispute with the majority shareholder of the company.

Advising a listed company in Hong Kong and its directors in relation to various investigations conducted by the Stock Exchange of Hong Kong, Securities and Futures Commission, Commercial Crime Bureau and Financial Reporting Council.

Advised an employee of a major bank in Hong Kong in relation to an investigation conducted by the Hong Kong Monetary Authority, including attending interview with the Hong Kong Monetary Authority together with the employee.

Advised a director and company secretary of a listed company in Hong Kong in relation to an investigation conducted by the Stock Exchange of Hong Kong and the company’s independent committee.

Advised a major university in Hong Kong in relation to regulatory, compliance and employment matters.
