Enforcement disputes: a case study

Our first article in this series (available here) summarised a recent English judgment in the long-running dispute between the Republic of Kazakhstan, the National Bank of Kazakhstan and Moldovan investors Anatolie Stati and Gabriel Stati (and their companies Ascom Group SA and Terra Raf Trans Trading Limited, the “Stati Parties”). The dispute between these parties has run for over seven years, with enforcement proceedings taking place in several jurisdictions. A number of practical issues arise from these proceedings which may be informative for those that are affected by court orders.
