Welcome to the fifth edition of Commodities in Focus (CIF) – our bulletin for clients engaged in the production, trading, carriage, storage and financing of commodities.

Our aim is to provide insights into legal issues, practical recommendations based on matters we have handled, and recent developments in the sector.

This edition opens with an article from Joanne Champkins, which looks at three recent cases that highlight the importance of properly drafted boilerplate clauses.

This is followed by two articles from Edward Davis covering recent judgments on the ISDA Master Agreement.

Finally, our Singapore colleagues have contributed two arbitration-specific articles. The first, from Timothy Cooke, deals with multi-tier arbitration agreements under Singapore law. The second, from Germaine Chia and Krystal Lee, looks at a recent English case where a financing bank found itself bound by the arbitration clause in a bill of lading it held as security.
