Commodities in Focus - Edition 6 2019
COMMODITIES IN FOCUS EDITION 6 2 Introduction Editor, Jonathan Spearing Welcome to the sixth edition of Commodities in Focus (CIF); our bulletin for clients engaged in the production, trading, carriage, storage and financing of commodities. Our aim is to provide insights into legal issues, practical recommendations based on matters we have handled, and recent developments in the sector. The theme of this edition is the ever present issue of fraud. It provides the focus for four articles, the first of which assesses an important Supreme Court decision on the setting aside of judgments obtained by fraud. We then look at a recent judgment of the Singapore High Court that will be of particular interest to financiers who take bills of lading as security over cargoes that are commonly discharged against LOIs. After a look at the escalating tensions in the Gulf and the jurisdictional issues considered by the Supreme Court in Vedanta v Lungowe, there then follows our usual case digest and selection of news items. We hope you find this bulletin both useful and interesting.
