Tracy’s practice spans asset tracing and recovery, civil and commercial litigation, and employment law. She acts for international corporations, financial institutes, school boards as well as private clients regularly, and provides them with practical advice and solutions.

Tracy is an of counsel at Stephenson Harwood. Before joining the firm, she was a consultant at the Hong Kong office of a leading PRC firm where she acted on a wide range of matters ranging from urgent injunction applications, cross-border trade disputes, shareholders’ disputes, to sensitive personal matters such as mental health cases, personal injuries claims and child adoptions.

She has extensive experience and knowledge in dealing with asset tracing and recovery cases. She represented victims of fraud or judgment creditors; she has also defended clients in resisting injunction and disclosure applications, and advised banks on the related applications and Court procedures.

Tracy also advises employers, senior executives and other employees on all aspects of employment-related issues, including recruitment, employment terms and benefits, employment policies, restrictive covenants, transfers and termination of employment. She handles employment disputes and conducts labour proceedings for her clients.

Tracy’s excellent client service, outstanding work quality and dedication to her craft is recognized by her having been named the exclusive winner for the Lexology Client Choice Awards 2022 in the area of asset recovery within the Hong Kong jurisdiction, whose winners are selected by nominations and submissions from corporate counsels exclusively.

Acted for a multinational food manufacturer-distributor in obtaining asset freezing and banker’s records orders against the recipients of funds upon discovery of the cross-border email and telephone fraud, and recovered the monies from numerous defendants by vesting orders and garnishee orders.

Participated in interpleading proceedings by the bank and defended competing claims on behalf of the fraud victim.

Acted for a well-known international art dealer in all Hong Kong-related proceedings including asset freezing applications which were part of the multinational disputes commenced by a wealthy art buyer on grounds of breach of fiduciary duty, fraudulent misrepresentation or deceit and wrongful interference with goods.

Obtained the first reported decision in Hong Kong granting an NPO in aid of post-judgment execution sought by a foreign judgment creditor against two banks for provision of bank documents relating to accounts of the judgment debtor.

Acted for a high net-worth investor in biotechnology companies in formulating his claims including claims based on fraud, and commenced legal proceedings against the partner for repayment of loans and funds advanced for investment purpose exceeding US$20 million.

Acted for the shareholders and directors of a company which in turn held substantial land interests in PRC, against their fellow PRC shareholders who fraudulently issued shares to control and take over the land, and succeeding both at first instance trial and on appeal.

Advised lay clients and professional clients such as Court-appointed deputies and public guardians in various stages of contentious and non-contentious proceedings involving mentally incapacitated persons, including the setting up and ongoing operation of committee, and recovery of assets held by third parties.

Represented plaintiffs and defendants in personal injuries claims arising out of workplace accidents, medical negligence, road traffic accidents and accidents on aircraft.

Defended the IMC of an Aided School in which the former principal sued on grounds of wrongful and unreasonable termination, breach of employment contract and/or breach of the Education Ordinance.

Acted for an international high-end jewellery retailer in the conciliation procedure conducted by the Labour Department, and assisted in its eventual settlement with the employee complaining about unfair dismissal and disability discrimination.

Advised and assisted a global electronic security and fire protection manufacturer and marketer in its Labour Tribunal proceedings against a former employee claiming additional bonuses.

Acted for the same electronic security and fire protection manufacturer in its High Court Action seeking injunctive relief and damages for breach of the non-competition and confidentiality agreement against an employee.

Acted as the general advisor of a DSS School for over six years and handled matters including advising the review panel in its investigations on the misconduct of teacher, advising in relation to disparaging remarks by an employee on social media, and reviewing various contracts, internal policies and codes.

Advised a luxury brands company in relation to data breach and enquiries from law enforcement bodies.

Representing a property investor in a dispute over sale and purchase contract for commercial properties in Guangzhou, China at the pre-construction stage (HKIAC-administered arbitration).

Acting for a multinational chemical’s supplier in its claims for loss and damages arising from the rejection by the buyer of a cargo of chemicals shipped from Thailand to Korea (HKIAC-administered arbitration under the ICC Arbitration Rules).

Representing the subsidiary of a Canadian-listed company, defending the buyer’s claim for return of purchase price following buyer’s own failure to collect the purchased coal from the mines in Mongolia (HKIAC-administered arbitration under the UNCITRAL Arbitration Rules).

Representing the shareholders of a Hong Kong company, defending claims over the sale and purchase of the company holding an interest in a PRC subsidiary and a piece of land (HKIAC-administered arbitration conducted in Chinese).

Advising an investor on a dispute concerning its purchase of the shares from 20 existing shareholders of a Hong Kong company (HKIAC-administered arbitration).
