Joint venture dispute

Acting for investors in a joint venture business relating to valuable artwork and assisting in bringing a claim in the High Court against our clients’ business partners for material breaches of various JV agreements.

LLP claim against members

Acting for the liquidators of a professional services LLP in bringing multiple claims against the firm’s former members following the LLP’s collapse.

Misappropriation of assets

Acting for a wealthy individual against his former agent in respect of the misappropriation of valuable assets. 

Security trust – enforcing security

Assisting with advising a security trustee on the way in which to enforce security, on behalf of the noteholders, in respect of over US$440 million of airline debt.  

Professional negligence – acting for ‘Big 4’ accountancy firm

Defending one of the ‘Big 4’ accountancy firms in a (threatened) claim, for c.£2 million, brought by their former client in respect of an investment in a complex tax arrangement (namely a ‘film, sale and leaseback’ scheme). The claim was successfully settled at the pre-action stage.

Professional negligence – acting for ‘Big 4’ accountancy firm

Defending a client in respect of a (threatened) claim, for over £7 million, relating to a similar investment involving a ‘film, sale and leaseback’ scheme.

Professional negligence – acting against a company’s former accountants

Advising a company in respect of its former accountants’ failure to implement an Enterprise Management Incentive (‘EMI’) scheme.

Breach of contract claim

Advising an individual facing a breach of contract claim after cancelling a high-value agreement with a wedding package provider. The claim was disputed on grounds of misrepresentation. A favourable, and cost-effective, settlement was achieved. 

Enforcement in/outside UK

Assisting an individual enforcing an English Judgment against her landlord resident in Poland.

Acting for a lender enforcing an Irish Judgment against a debtor resident in England. 

Rent deposit

Acting for a former retail tenant of a Westfield shopping centre seeking the recovery of its rent deposit. A favourable settlement was achieved through successful without prejudice negotiations.
