Package travel regulations

Advised three airlines and package travel company on the implication and incorporation of the Package Travel and Linked Arrangements Regulations 2018.

Package travel regulations – start-up

Assisted with the incorporation and set-up of a start-up package holiday company in the UK.

Advised airlines on compliance with EU Regulations, namely relating to passenger rights.

Airlines – impact of Brexit

Advised airlines on the impact of Brexit on the aviation regulatory regime; the client’s business, and recommended protection mechanisms.

Danish air show

Advised the insured (the organiser of the air show) and its insurer on viability of claim for recovery of losses under contract and tort against the exhibitor and/or potential other third parties.

Disputes following a fuel supply breakdown at a large international airport in Portugal

Advised the client, the supplier of fuel, on the potential exposure in contract and tort to its customers following the complete shutdown of the fuel supply system at a major EU airport for 12 hours. Assisted the insured with communications and action steps following government investigation into the incident and the outcome of the formal investigation report by the national fuel supply authority. Negotiated the current claims brought by airlines, against the insured, for damages arising from the disruption.

Subrogation recovery claim against a service provider following damage to a Boeing 747

Acted for a leading Japanese aviation insurer in the Irish commercial courts on a subrogation claim in the name of the insured (an operator of a fleet of cargo airplanes), against the supplier of pilots, engineers and technical staff contracted to provide trip co-ordination, crew and operational flight support, for damages to the aircraft following a ferry flight and demonstration flight from Japan.

Claim for damages for the repair of an aircraft caused by breach of implied duty

Advised Insurers and the Insured (the operator and owner of the aircraft) on the merits of a claim action against the ground handlers at Luton Airport for damage caused by its failure to exercise reasonable skill and care. Assisted with the settlement negotiations to avoid costly litigation.

Claim for partial loss of shipment of ventilation equipment

Acted for a Chinese-owned aviation services company in defending a claim for the loss of shipment from its facility at Algiers Airport, which was travelling by air from Atlanta to Algiers via Doha. The contract of carriage was governed by Warsaw/Hague Convention, which provided a limitation on liability.

Claim for Personal injury sustained during fire training course at a regional English airport

Acted for the defendant, the parent company of the operator of Blackpool Airport. Drafted the successful application to strike out the claim and secured an award for costs for the Defendant, despite the case being governed by qualified one-way costs shifting.
