Marine and international trade
Hayley has a wide range of experience in the resolution of disputes in the shipping sector, regularly acting in LMAA arbitrations. Hayley acts for both Owners and Charterers, dealing with complex charterparty disputes in respect of issues such as safe port warranties, off-hire claims and breach of maintenance obligations.
Hayley also has experience in disputes arising out of shipbuilding contracts, including termination of shipbuilding contracts and disputes arising at delivery of the vessel.
As well as contentious work, Hayley's experience includes non-contentious contract negotiation and drafting, including the drafting of shipbuilding contracts, most recently assisting with shipbuilding contracts for a high value fleet renewal in respect of dual-fuel vessels.
Shipowners
Acting for Owners in respect of a claim against Charterers for breach of the safe port warranty and ice free clause following a voyage through ice that resulted in damage to the propeller.
Acting for Owners in respect of bareboat Charterers' claim for repair costs associated with latent defects and Owners' counterclaim for Charterers' breach of maintenance obligations. Also acting for Owners in respect of a concurrent arbitration with the subsequent bareboat Charterers of the same vessel in connection with the maintenance obligation issue.
Acting for Owners in respect of a claim against Charterers for unpaid hire arising out of the vessel's detention by local authorities following the discovery of narcotics onboard.
Acting for Charterers in respect of two disputes with Owners related to, amongst other issues, alleged unpaid hire, arising out of the condition of Owners' vessels. Further advising Charterers in respect of potential claims brought by cargo interests following Owners' exercise of a lien over freight/cargo.
Acting for Charterers in respect of a claim brought by Owners for unpaid hire, and Charterers' counterclaim related to termination of the charterparty.
Shipyards
Advising a German shipyard on issues arising out of the termination of a shipbuilding contract.
Advising a Turkish shipyard on the English law assignments of several Norwegian law shipbuilding contracts to the Norwegian buyer's Russian financier. Issues arose once the Russian financier became a sanctioned entity.
Shipbuilding
Advising Höegh Autoliners in respect of the negotiation and drafting of shipbuilding contracts with China Merchants Heavy Industry (Jiangsu) Co., Ltd for multi-fuel, zero carbon ready PCTC vessels for Höegh Autoliners' newbuilding programme.
Advising the buyers of an arctic cruise vessel in respect of issues arising out of the yard attempting to tender the vessel for delivery in an incomplete state.
