Diana is an associate in our construction and engineering disputes team.  She acts for construction clients in various dispute resolution mechanisms including mediations, adjudications, arbitrations and court proceedings.  Diana also advises her clients on the applicability of their insurance policies to disputes and acts for them on coverage issues.

Her experience includes defending contractors against allegations of defective work, breach of contract, negligence as well as breach of Building Regulations.

In the context of Private Finance Initiative (PFI) projects, Diana advises on a range of disputes including acting for contractors on issues concerning defective cladding and fire safety regulations, assisting a Hard FM Contractor with disputes arising out of the running of services in a public hospital, and advising Project Co on a dispute with the relevant authority regarding the maintenance of school grounds.  She also advises on contract termination cases and assists her clients in recovering unpaid invoices.

Alongside construction disputes, Diana has experience advising her clients on the applicability of insurance policies such as Professional Indemnity and General Liability to claims made against them and works alongside the insurer working towards the resolution of these claims.

Defective Cladding Claim involving Nine Residential Towers
Acting for the refurbishment contractor in a £140 million, multi-party claim relating to cladding and fire safety issues on nine residential towers refurbished as part of a PFI project. 

Public Hospital Services Dispute 
Acting for a Hard FM Contractor in a dispute arising out of the insolvency of Project Co and advising on the applicable termination procedure as part of a PFI Project. 

Maintenance of School Grounds Dispute 
Acting for Project Co in a dispute where deductions have been applied by the Authority due to maintenance allegations in a PFI context. 

Multi-day Arbitration on Termination of Contract 
Acting for a Contractor in a 6.5-day arbitration over an issue of whether the failure to provide sufficient designs in the build-only contract was a proper ground for termination by the Contractor. 

Defective workmanship claims following the Canterbury Earthquakes, New Zealand
Defending a contractor against a variety of multi-party claims made against them in the High Court (NZ) relation to historic repair work done by the contractor following the 2010 and 2011 Canterbury Earthquakes. These claims involved a number of cross-claims between defendants, counter claims against the plaintiffs and the joining of third parties to the proceedings.

Nunnery Demolition: Duty of care and asbestos contamination
Acting for a religious commune as plaintiffs in a High Court claim, followed by mediation, against the Attorney-General as a result of asbestos being identified in their land following demolition of the convent where such demolition had been organised by government agencies following damage in the Canterbury Earthquakes. 

Adjudication: Non-payment for Building Services Consultant
Acting for a building services consultant in an adjudication under the Construction Contracts Act 2002 (NZ) seeking payment of unpaid invoices and defending elaborate defective work allegations raised within the response by the respondent.
