Mark has specialised in pensions law for over 25 years. This experience means that he has encountered most questions that arise in the pensions field. It also means that he can communicate the issues clearly and provide solutions that work.

Mark joined Stephenson Harwood in 2002 and has grown the pensions practice to one of the largest in London, heading a team of 10 specialist pension professionals.

He advises both trustee boards and sponsoring employers on all aspects of pension law. In either case, he helps clients achieve their objectives in a pragmatic and cost effective way.

Mark has participated in the SORP1 working party, the Society of Pension Consultants legislative sub-committee and the Association of Pension Lawyers Main Committee. He is currently on the editorial board for Lexis PSL Pensions and is a contributor to webinars on current pension issues.

Cessations of accrual

Involved and advised in many proposals to cease accrual of further benefits under defined benefit pension arrangements from employer and trustee perspectives. Experience suggests that whilst common themes arise, each case is different.

Restructurings

Advising on cases which involve considering a restructuring of the sponsoring group or a restructuring of a group’s pension arrangements.

Security

Advising sponsors on a number of ways in which they can improve the funding position and security of their arrangements through the use of assets in a way which does not hand over control.

Catchpole v Alitalia Airlines Pension Scheme

A rare example of a member using estoppel successfully to establish an entitlement to a benefit where we acted for the member. This is a leading case on this complex area of law.

Sterling Insurance Pension Scheme

Advised on a case involving the construction of a restriction in a power of amendment where we successfully acted for the Trustees. The case is now due to go to the Court of Appeal this year.

Pension Ombudsman

Advising clients on recent claims involving transfers of DC benefits, communications of benefit entitlements, allocation of death benefits and entitlement to incapacity benefits.
