In Quinn Direct Insurance Ltd v the Law Society [2010] EWCA Civ 805, the English Court of Appeal confirmed that a solicitor’s PI insurers may have little or no access to the insured’s files if the underlying client does not waive privilege. This may be of concern to insurers but is potentially much worse for the insured.
