The past three months of IP cases have seen a retrograde step on the subject of IPO trade mark proceedings preventing future claims by rights owners, a significant number of cases highlighting the importance of clear drafting in IP contracts, examination of the copyright criminal provisions, more on the dangers of writing letters which impliedly make an 'unjustified threat' of legal proceedings and Virgin Atlantic's flat bed patents have been found on appeal not only to be valid but also to have been infringed. Summaries of the key cases are set out in this issue.
