Stefan is an associate in Stephenson Harwood's award-winning rail team. Stefan offers a unique perspective to public and private sector clients in the railway industry, gained from his experience working in-house at the Department for Transport (DfT) and at one of the UK's leading rail operators.

Stefan's experience in government included assisting in the direct award and mobilization of the West Coast rail franchise and advising the DfT on the termination of the East Coast rail franchise in 2018. Stefan was also involved in advising the government on the 2017 judicial review and underlying contractual issues in connection with the Govia Thameslink Railway (GTR) franchise. Since joining Stephenson Harwood, Stefan has been involved in advising a large rolling stock manufacturer in relation to the procurement of trains and maintenance services for the High Speed Two project.

Stefan's areas of interest include the government’s use of alternative risk transfer mechanisms in franchise agreements and public-private sector partnerships generally. His work in this area includes advising the DfT on the development of the Forecast Revenue Mechanism, as well as various management contract models. Stefan has published articles commenting on these and other issues facing the railway industry.

Stefan is dual-qualified and, prior to his work in the UK, practiced at several firms in New York, focusing on litigation. He speaks fluent German.

Freedom of Information

Advising the DfT on the handling of Freedom of Information requests.

Data projection

Advising the government on the implication of GPDR in terms of use of the processing of personal data in the rail franchising context.

Governance and control

Advising the government on the development of policies for the protection and management of commercially sensitive information in the procurement sphere.

Rail contracts

Advising the DfT and train operating companies on all aspects of the rail industry, including franchise competitions and direct awards and the on-going operation of franchise agreements.

Rolling stock

Advising a rolling stock manufacturer (CAF) on the manufacture and maintenance arrangements for various UK bids, including the HS2 rolling stock procurement.

Regulation

Advising the DfT and train operators on compliance with the Railways Acts, EU procurement law on rail franchise procurement (Regulation 1370), and the Equality Act 2010.

Judicial review

Advising the DfT on the judicial review brought by the Association of British Commuters into the Secretary of State's handling of the Govia Thameslink Railway (GTR) franchise.

Public procurement

Advising the government and train operators on compliance with EU Regulation 1370/2007 and the Utilities and Contract Procurement Regulations.

Regulation

Advising the DfT on the performance of its statutory duties under the Equality Act 2010, the Railways Acts, and related secondary legislation.

Day-to-day operations

Advising the DfT on contractual and commercial management of rail franchises, including the West Coast and East Anglia franchise, as well as the East Coast franchise during its operation by Stagecoach. Also advising train operators on contractual matters related to their rail franchises and supply agreements.

Direct awards

Advising the DfT on the 2018 award of the Intercity West Coast franchise.

Rolling stock

Advising a rolling stock manufacturer (CAF) on the manufacture and maintenance arrangements for various UK bids, including the HS2 rolling stock procurement.

Regulation

Advising the DfT and train operators on the full range of laws and regulations governing the railway industry.

Franchise competition pre-qualification

Advising the DfT on various aspects of the "Passport" system of pre-qualification of bidders in rail franchise competitions.
