Natasja is an Australian qualified associate with extensive experience in complex, commercial litigation and dispute resolution in the Middle East and Australia.

Natasja advises and represents clients on a broad range of commercial matters, including mining, oil and gas and shipping disputes, construction disputes and insurance matters. She has a particular expertise in arbitration proceedings (predominantly ICC and DIFC-LCIA) and DIFC employment matters. Natasja was involved in the precedent setting case on the application of the Article 18 Employment Law penalty in the DIFC.

She has acted for and represented a variety of clients in DIFC-LCIA and ICC arbitrations, the DIFC Court, the Courts of Western Australia and the Federal Court of Australia. Her clients vary from conglomerates to large and mid-size companies, insurers and individuals.

Natasja also has experience in shareholder disputes, advising directors and officers, statutory investigations, civil penalty proceedings and property disputes.

She trained and worked in Australia on complex, large scale litigation in the natural resources sector. In Australia, Natasja also acted for the largest insurer of medical professionals in Australia, representing a wide range of medical professionals in disciplinary proceedings, vocational regulation proceedings and common law negligence claims. She also sat on the Football West Disciplinary Tribunal.

Natasja is registered with the Dubai Legal Affairs Department and the Legal Practice Board of Western Australia. She is also a DIFC Part II registered practitioner, and is admitted to appear the Courts of Western Australia and the Federal Court of Australia.

Manufacture and supply agreement disputes

Acted for a large Chinese owned mining infrastructure provider in a dispute with a former contractor concerning the termination of a Manufacture and Supply Agreement. The case involved aspects of fraud and was resolved with a positive outcome for the client.

Oil and gas leak litigation

Acted for Atlas Drilling in relation to the 2009 oil and gas leak on the Montara Platform (including advising the client in relation to insurance aspects arising from the total loss of the client's mobile offshore drilling unit, and representing the client during the Montara Commission of Inquiry and the National Offshore Petroleum Safety Authority investigation).

Royalty entitlement and proprietary disputes

Acted in relation to multiple significant disputes concerning proprietary interests in mining tenements in Western Australia and royalty entitlements arising from the extraction of iron ore.

Exclusive distributor relationship disputes

Advised an oil and gas service company in the USA in relation to issues with an exclusive distributor relationship in the UAE and the termination of that distributor relationship.

Entitlements claims

Acted for an individual in respect of an employment claim setting the precedent on the application of Article 18 of the DIFC Employment Law. Both the Court of First Instance and the Appeal judgment were in favour of the client.

Discrimination claims

Acted for an Emirati woman individual in respect of a discrimination claim against her employer (a prominent DIFC based bank). The matter was resolved in favour of the client.

Redundancy claims

Acted for three former staff members of a well-known DIFC based bank in relation to claims arising out of the termination of their employment. The matter was resolved in favour of the clients.

General employment advice

Provided employment advice and assistance to a technology company on retainer on a variety of issues, including pensions, redundancies, termination of employment, international transfers and regulatory and compliance issues.

ICC arbitration

Acted for a Pakistani company in an ICC arbitration pursuant to French law in relation to a claim for outstanding payments under a services agreement regarding a water sanitation resource facility in Faisalabad City.

DIFC-LCIA arbitration/lease dispute

Acted in a DIFC-LCIA arbitration for owners of a well-known London restaurant regarding a lease dispute relating to a DIFC property. The award was in favour of the client and the case was a precedent case for the application of the cure provisions in the DIFC Contract Law (Article 80).

DIFC-LCIA arbitration/litigation funding agreement

Acted for a law firm in a DIFC-LCIA arbitration arising out of a litigation funding agreement.

Sale contract disputes

Advised on a variety of disputes arising under sale contracts for natural resources (iron ore, oil and precious metals).

Royalty entitlement and proprietary disputes

Acted in relation to multiple significant disputes concerning proprietary interests in mining tenements in Western Australia and royalty entitlements arising from the extraction of iron ore.

Operational issues and disputes

Provided day-to-day advice to a large iron ore and magnetite producer in relation to its operations at one of its magnetite iron ore mine and facilities.
