Mabel has broad experience in advising and representing clients in shipping disputes involving charterparties and bills of lading. Her clients include shipowners, charterers, cargo interests, P&I Clubs, insurers and claims handlers. She has also dealt extensively in commodities trading disputes and has had the privilege of working with industry experts on commodities such as coal.

She is critically aware of issues of enforcement even at early stages of proceedings and will advise her clients to take strategic and practical steps to maximise potential of recovery under an award or judgment.

Arrest and seizure of vessels

Advising and representing clients who wish to arrest vessels as a form of security or seize vessels to enforce a judgment award. This extends to instructing overseas counsel on arresting vessels in other jurisdictions.

Advised and acted for beneficial owners in multiple vessel arrests across 5 jurisdictions on disputes over vessel ownership and involving issues of sanction implications.

Charterparties and bills of lading

Advising and representing owners, charterers and cargo interests in disputes that extend to the enforcement of back-to-back indemnities and liens, mandatory and prohibitory injunctions relating to cargo discharge and general average claims. This area of dispute covers standard charterparty forms such as the NYPE, Baltime, Gencon and Asbatankvoy.

Advising clients and instructing Indonesian solicitors in Indonesian court proceedings involving a claim for general average contribution in the sum of approximately US$1.2 million.

Letters of credit and guarantees

Advising and representing clients on validity of LC discrepancies and payment obligations under LCs and guarantees.

Advised clients on an off-hire claim premised on delays caused by the master’s rejection of the bauxite cargo due to concerns of potential liquefaction of cargo.

Advised and acted for coal purchasers in Singapore High Court and Court of Appeal proceedings involving claims for non-compliance with contractual specifications and payment under letter of credit and guarantees.

Cargo specifications compliance

Advising and representing clients in disputes over specifications and delivery of cargoes such as coal, iron ore, scrap and calcium carbide. This area covers standard form agreements such as the SCoTA v8 and guidelines such as the ISRI Scrap specifications.

Advised and acted for sellers against buyers who refused to take delivery of scrap cargo and alleged non-compliance with the ISRI Scrap specifications.

Freight forwarding

Advising and representing freight forwarders in disputes on liability, indemnity and bailment involving industry's standard rules and guidelines such as the SLA Standard Trading Conditions, FIATA Model Rules and the IATA Perishable Cargo Regulations.

Advised and acted for freight forwarders disputing liability for temperature abused cargo handled by the airline in a claim by the shippers.

Advising and representing parties in commodities trading and chartering businesses in cases involving allegations of fraud, conspiracy and misrepresentation.

Advised and acted for commodities purchasers in Singapore High Court and Court of Appeal proceedings involving claims fraud, conspiracy and misrepresentations.

Illegality

Advising and representing clients in disputes involving allegations of corruption and bribery in violation of the Prevention of Corruption Act and
Investigations by the Corrupt Practices Investigation Bureau.

Advised and acted for international freight forwarders to defend allegations of bribery and to respond to investigations by the Corrupt Practices Investigation Bureau of Singapore.

Enforcement

Advising and representing judgment creditors in garnishee proceedings, examination of judgment debtor, seizure and sale of assets, winding up proceedings and schemes of arrangement.

Advised and acted for judgment creditors in enforcement proceedings involving a Mareva injunction order prohibiting the removal of a yacht and the execution of a writ of seizure and sale to sell the yacht in satisfaction of a court judgment.

Advised and acted for judgment creditors in recovery of outstanding debts through a proposed scheme of arrangement.
