Kate has experience in a wide range of commercial disputes – with a focus on professional liability claims and banking and finance disputes. She has acted on a number of high profile complex cases, often with an international element.

Kate's work includes the Tchenguiz litigation – regarded as one of the most complex and high profile disputes before the English courts in recent times and acting in the leading case on the arguability of LIBOR manipulation against banks.

Her practice has particular focus on professional liability claims, having previously been seconded to the Risk Management team of one of the Big 4 firms. She has continued to represent them in various claims post-secondment.

She is regularly involved in banking and financial services litigation, acting in claims involving complex financial instruments. She also has experience of interlocutory and post judgment applications including freezing injunctions and receivership orders.

Successfully assisting an overseas bank in avoiding FCA enforcement action in relation to a money laundering investigation concerning their dealings with politically exposed persons.

UK LIBOR investigation

Representing an individual who was the subject of FCA and SFO LIBOR investigations.

Advising an insurance company on the development and implementation of a redress scheme.

Cruz City 1 Mauritius Holdings v Unitech Limited & Ors

Acting for Unitech Limited and related companies contesting enforcement of LCIA arbitral awards totalling US$350 million arising from shareholders' agreements in a series of applications by Cruz City including for a worldwide freezing order and subsequent appointment of receivers by way of equitable execution.  

Deutsche Bank AG & Ors v Unitech Global Limited and Unitech Limited

Acting for the defendants in a US$170 million loan claim by Deutsche Bank and other syndicate banks, and an associated US$12 million swap claim. This is the leading case on the arguability of LIBOR manipulation against banks. This was listed by the Lawyer as one of the top cases of 2014.

Advising a property investment company in relation to a High Court claim brought against one of the leading high street banks concerning the mis-selling of complex derivative products.

Tchenguiz Family Trust v Kaupthing

Acting against Kaupthing Bank (in liquidation). The sums involved represented a third of the GDP of Iceland. Stephenson Harwood was awarded Litigation Team of the Year in 2012 (The Lawyer) for this litigation.
