Joanne acts for and advises commodities producers, traders and end users, shipowners, charterers and insurers on the resolution of disputes arising under marine contracts including sale contracts, charterparties, bills of lading, insurance policies, COAs and MOAs.

Joanne has advised in relation to a broad range of disputes concerning a variety of commodities including crude oil, petroleum products, base metals, precious metals, agricultural commodities, industrial gases and dangerous cargoes.

Based in Dubai, Joanne has previously trained and worked in London and has acted for clients in English and UAE court proceedings and in arbitration forums including DIFC-LCIA, LCIA, LMAA, ICC, GAFTA and FOSFA.

Joanne also advises on sanctions, in particular Iranian sanctions, and the legal possibility of and risks involved with carrying out transactions connected with sanctioned countries and entities.

Sale contract disputes

Advising on wide variety of disputes arising under sale contracts for crude oil, petroleum products, metals, precious metals, agricultural commodities and industrial gases.

Crude oil/ownership

Acting for a multinational trading house in proceedings in the UAE Courts and English High Court to determine ownership of crude cargoes valued at US$120 million. Successfully achieving a ruling in favour of the client at Court of Cassation level in the UAE.

Base oil/contamination 

Acting for UAE trading house in LMAA arbitration proceedings concerning the recovery from seller and/or carrier for losses suffered as a result of delivery of a contaminated base oil cargo.

Green peas/quality 

Advising multinational grain trading company in relation to multi-jurisdictional proceedings including a quality dispute brought in India in breach of arbitration agreement, anti-suit injunction proceedings in England, letter of credit proceedings, and GAFTA arbitration proceedings.

Ethylene cargo/explosion

Acting for major US producer of industrial gases and its cargo and liability insurers following an explosion of the client's ISO container of ethylene on a vessel stationed at an Angolan port involving court proceedings in the UK, Holland and the US.

Metals contract/default

Acting for multinational metal trading house in an English court dispute concerning the existence of and non-performance of a sale contract for iron-ore.

Advising a multinational carrier (and its insurers) in relation to its claim in the English Court against a shipper of nitric acid for recovery of losses arising from the explosion in a middle eastern port of a container filled with nitric acid.

Charterparty fixture/existence of contract

Acting for Korean owner (and its insurers) in an arbitration relating to a question as to whether a fixture had been entered into following telephone negotiations. Successfully obtaining judgment in the client's favour from the English Court at appeal.

Long term COA/termination

Advising a government entity on the termination of a 15 year COA with a far above market annual price. Subsequently drafting new COA and tender documents for the contract.

Ship management dispute/arrest

Advising managers in relation to breaches of ship management agreements, arresting vessel in the UAE and commencing arbitration under DIFC-LCIA Rules.
