Having served as the head of the international legal affairs department of one of the major Korean shipyards, Hong Bin has vast experience in drafting, reviewing and negotiating EPC and shipbuilding contracts, subcontracts for engineering and major equipment, and compliance issues in respect of offshore production facilities, rigs, commercial and military vessels.

Hong Bin is conscious of the risks of the various parties involved in offshore and commercial vessel projects, and has successfully negotiated terms for clients. His experience includes successful negotiation of terms and conditions for EPC projects for an FLNG and arctic LNG carriers, both the first of their kinds. His contentious experience includes construction of terms relating to design responsibility, termination for parties’ events of default, delay claims attributable to force majeure clause, scope of warranty obligation. His non-contentious experience includes successful negotiation of patent licensing and know-how transfer agreements and joint venture projects for technology transfer. He also served in the world’s biggest electronic goods engineering and manufacturing company. He negotiated the terms and conditions for development and supply of solid state drives for an enterprise use. He is familiar with issues arising out of licensing agreements.

He is also familiar with the issues relating to commodity trading, payment instruments, bill of lading, charterparty and cargo insurance. He regularly advises on issues relating to indemnities under EPC contracts and coverage of WELCAR insurance policy.

Hong Bin qualified in a firm in the City of London specialising in international trade and commodities, shipping, shipbuilding and insurance. He conducted various arbitration matters under the rules of arbitration of LMAA, LCIA and GAFTA.

Daewoo Shipbuilding and Marine Engineering Co., Ltd

Negotiated an EPC contract for an FLNG with a view to providing exceptions to fixed time and costs in light of shared understandings of commercial settings, and assisted with successful delivery of the same. Negotiated a Frame Work Agreement with a US oil major company for engineering, production and construction of offshore production facilities.

Daewoo Shipbuilding and Marine Engineering Co., Ltd

Advised on LMAA arbitration matters involving issues of design responsibility for a prototype rig and termination of commercial vessels for reason of alleged "insolvency".

Samsung Corporation Co., Ltd

Carried out an LCIA arbitration in relation to issues arising out of an exclusion clause and successfully defended the claims.
